For Landlords – Rights & Limits

 

You CAN:

  • Receive agreed rent on time.
  • Increase rent once every 12 months with proper notice.
  • Evict only through Rent Controller/Tribunal – never by force.
  • Claim damages for tenant-caused harm beyond normal wear.

You CANNOT:

  • Cut utilities, change locks, or remove belongings without court order.
  • Enter premises without tenant’s permission (except emergency).
  • Evict without legal grounds.

For Tenants – Your Rights

 

You have the right to:

  • Written agreement (verbal is risky).
  • Peaceful possession – no eviction without court order.
  • Utilities – landlord cannot disconnect them.
  • Protection from arbitrary rent hikes.
  • Refund of security deposit (minus legitimate deductions).

If landlord refuses to accept rent:

→ Deposit it in court (Rent Controller) or send via money order. Keep proof.

Illegal acts by landlord:

  • Changing locks / throwing out belongings.
  • Harassment or forced entry.
  • Cutting off water, gas, electricity.
  • False “personal need” eviction (in Sindh, you can reclaim possession under Section 15‑A if landlord misuses property).

 

Eviction – Legal Grounds & Process

Valid grounds (all jurisdictions):

  • Non‑payment of rent (after legal notice).
  • Subletting without written consent.
  • Change of use (e.g., residential to commercial).
  • Damage to property.
  • Landlord’s bona fide personal need (must be proved).
  • Expiry of fixed term without renewal.

Step‑by‑step eviction process:

  1. Legal notice (15‑30 days).
  2. File petition before Rent Controller / Tribunal / Cantonment Rent Controller.
  3. Tenant files reply → court grants leave to contest if disputed.
  4. Evidence & cross‑examination.
  5. Judgment.
  6. Appeal (to District Judge or High Court).
  7. Execution (court bailiffs/police enforce possession).

⚠️ Landlord self‑help = unlawful eviction (criminal liability).


Security Deposits – Avoid Disputes

Deduct only for unpaid rent, bills, or actual damage (not wear & tear).

Take move‑in photos/videos.

Return deposit within 15‑30 days with itemized deductions.

Give proper notice, leave property clean.

Recent Key Rulings (2024‑2026)

  • IRRO applies to entire ICT – not just “urban areas” (*2024 CLC 274*). Tenants in Ghauri Town, Bahria Town, etc., can now approach Rent Controller.
  • Sindh Section 15‑A strengthened – Landlord who evicts for false personal need and misuses property can be forced to restore possession (2025 Supreme Court ruling).
  • Cantonment areas – Ignoring a tentative rent deposit order can lead to defense struck off and immediate eviction (Clifton case, 2025).
